De manera paradójica, la actualidad de la hermenéutica debe buscarse en su diálogo con la tradición filosófica. Diálogo que daría comienzo, en primer lugar, con su recepción de Husserl, la cual no se puede entender tanto como una traición al proyecto fenomenológico cuanto como un llevarlo hasta sus últimas consecuencias. En segundo lugar, la vuelta sobre el proyecto moderno conduciría a un dialógo con Kant y a la discusión de la posición de un sujeto trascendental como condición de la objetividad. (...) Requiring family authorization for apnea testing subtracts health professionals control over death determination, a procedure that has traditionally been considered a matter of clinical expertise alone. In this commentary, we first provide evidence showing that health professionals’ (HPs) disposition to act on death determination without family’s prior consent could be much lower than that referred to by Berkowitz and Garrett (2020). We hypothesize that HPs may have reservations about their own expertise as regards death, and may thus hesitate to impose (...) their views on patients’ families. We then address the theoretical question of clinical expertise in death determination by distinguishing judgments about facts (e.g., the presence or absence of spontaneous breathing) from interpretations given of these facts (i.e., their meaning for the vital status of an individual). We argue that, while clinicians may claim some expert authority on the former, they hold no particular authority on the latter. (shrink)

This article captures and critiques a recurring and prominent political argument against animal welfare improvements in Switzerland which we term the “ranking argument”. This states that Swiss animal welfare law ranks among the strictest in the world, therefore no improvements are called for. This argument was advanced three times by Swiss government authorities in 2022 alone, but also in a case dating back to 1984, to advise the electorate on popular initiatives aiming at animal welfare improvements. We argue that, while (...) the argument commits a fallacy of relative privation and is ethically dubious, it can be deployed to great effect by agents opposed to norm change in animal welfare regulation. A lo largo de la tradición psicopatológica, incluso de la pre-fenomenológica, se encuentra la categorización del delirio como creencia. Jaspers asumió ese uso y lo fundó fenomenológico-existencialmente, definiendo su carácter de convicción. El concepto de creencia ha tenido un largo recorrido dentro de la historia del pensamiento, aunque recientemente se ha intensificado el debate acerca de la visión doxástica del delirio. En virtud de lo ya mencionado, en el presente artículo presentamos un análisis conceptual de la creencia, con el objetivo (...) de identificar de manera precisa los aspectos esenciales que permiten al delirio definirse según ella. De esta manera, se discutirán algunas de las principales incursiones realizadas en el concepto desde la antigüedad periplatónica hasta José Ortega y Gasset, remarcando en cada pensador las directrices esenciales de su aproximación a la creencia. A su vez, introducir al filósofo español al debate psicopatológico permitirá incluir en la discusión dos aspectos importantes que creemos pueden ser fructíferos para la discusión filosófica sobre el delirio: la diferencia entre ideas y creencias, y la vitalidad de estas últimas. Finalmente, hacemos referencia al actual debate pro- y antidoxástico, haciendo hincapié en la necesidad de considerar la amplitud del concepto de creencia en su genealogía histórica. Con base en ello estaríamos en condición de acercarnos a la visión doxástica moderada que han defendido autoras como Lisa Bortolotti. (shrink)

El manual escolar sigue siendo un recurso didáctico clave en la enseñanza de la historia. En Educación Primaria y Secundaria pervive su uso, a pesar de las numerosas reformas educativas llevadas a cabo desde hace siglo y medio. Este trabajo pretende analizar su vigencia, estructura y cambios a lo largo del tiempo. Los cada vez más numerosos estudios se han escrito desde una perspectiva española o portuguesa, así que interesa conocer la evolución paralela y establecer comparaciones. Se analizan las escuelas (...) historiográficas y pedagógicas que han influido en la evolución de los currículos educativos. Materialism has been the subject of extensive and rich controversies since Robert Boyle introduced the term for the first time in the 17th century. But what is materialism and what can it offer today? The term is usually defined as the worldview according to which everything real is material. Nevertheless, there is no philosophical consensus about whether the meaning of matter can be enlarged beyond the physical. As a consequence, materialism is often defined in stark exclusive and reductionist terms: whatever (...) exists is either physical or ontologically reducible to it. This conception, if consistent, mutilates reality, excluding the ontological significance of political, economic, sociocultural, anthropological and psychological realities. Starting from a new history of materialism, the present book focuses on the central ontological and epistemological debates aroused by today’s leading materialist approaches, including some little known to an anglophone readership. The key concepts of matter, system, emergence, space and time, life, mind, and software are checked over and updated. Controversial issues such as the nature of mathematics and the place of reductionism are also discussed from different materialist approaches. As a result, materialism emerges as a powerful, indispensable scientifically-supported worldview with a surprising wealth of nuances and possibilities. (shrink)

The use of some nonhuman primates in invasive research—unlike that on animals more generally—has been severely restricted or banned in much of the world. This trend toward severe restrictions or bans raises the question: Has the time come to end invasive research with all primates? In this chapter, we offer an overview of the main ethical questions surrounding the use of primates in invasive research, evaluate some of the leading arguments in favor of and against such research, and propose some (...) ethical recommendations for conducting this research. As we argue, the case for phasing out the use of primates in invasive research is not as straightforward as some might think. Stringent restrictions must be adopted if scientifically and ethically justifiable invasive research with primates is to continue. (shrink)

Zadie Smith’s latest novel, NW, presents a multiverse in which multiplicity is driven into homogeneization by the forces of those dominant discourses that attempt to suppress the category of the “Other.” This paper focuses on the development of the two female protagonists. Their opposing attitudes towards motherhood, together with their confrontation with their origins, bring to the fore the performativity found in the discourses of gender, sexuality, class, and race. The paper analyses Benardete's paradox of the gods from a more general perspective (the convergence approach) than several of the most important proposals made to date, but in close relation (and sharp contrast) with them. The new theory, based on the notion of limit, is systematically applicable in different possible scenarios involving a denumerable infinity of objects. In particular, it reveals in what way ω-consistency can be compromised in an otherwise consistent description of such "infinitary" situations.

This article analyses the multimodal representations of public space in Chilean broadcast news reports on the figure of the hooded rioter and its alleged connections with the student movement. We seek to identify how space is constructed as a legitimation strategy in relation to the actors involved and the actions taking place across four different news broadcast pieces in the light of Multimodal Critical Discourse Analysis and Systemic Functional Linguistics. Results show that the multimodal representations of space are crucial to (...) identify and functionalize hooded rioters as belonging to the student movement. Actions are dependent on the spaces in which actors operate, restricting the occupation of certain spaces to specific actors. Thus, transgressive protest actions are to be contained to educational spaces and represented as naturalized vandalism, ignoring the students’/demonstrators’ motivations to recuperate/vindicate the public space. El artículo versa sobre el uso de las nociones "Dios" y "soberano" en la Baja Edad Media. A su vez, trata de mostrar las diversas analogías entre las propiedades ambos conceptos (omnipotencia, unidad, ilimitabilidad, indivisibilidad), así como: 1° los problemas explicativos de la relación Dios-mundo y Estado-Derecho ; 2° la analogía entre el milagro y el poder constituyente originario ; 3° la afinidad entre el dogma de la infalibilidad papal y la cosa juzgada. En último lugar, se hace referencia a (...) la función justificatoria de estas analogías con el propósito de legitimar el papel de soberano en un momento histórico de profundos cambios sociales, políticos y jurídicos. In two experiments, we demonstrate that intentional action intuitions vary as a function of whether one brings about or observes an event. In experiment 1a (N?=?38), participants were less likely to judge that they intended (M?=?2.53, 7 point scale) or intentionally (M?=?2.67) brought about a harmful event compared to intention (M?=?4.16) and intentionality (M?=?4.11) judgments made about somebody else. Experiments 1b and 1c confirmed and extended this pattern of actor-observer differences. Experiment 2 suggested that these actor-observer differences are not likely (...) to occur when participants are asked to ?imagine? being an actor. We argue that these results challenge the substantial philosophical and empirical reliance on hypothetical thought examples about intentional action. Our data offer new and necessary methodological avenues for understanding folk intentional action intuitions. (shrink)

Sin embargo, las diferencias materiales que existen entre los individuos pueden influir de una forma decisiva en el desarrollo del proceso deliberativo.En este artículo examino la forma en que desde esta teoría de la democracia se ha hecho frente a este problema. Aunque encontramos notables diferencias entre los autores, todos ellos defienden la necesidad de garantizar una igual influencia de los ciudadanos en el proceso político.

Transcranial Magnetic Stimulation (TMS) is a non-invasive neurostimulatory and neuromodulatory technique increasingly used in clinical and research practices around the world. Historically, the ethical considerations guiding the therapeutic practice of TMS were largely concerned with aspects of subject safety in clinical trials. While safety remains of paramount importance, the recent US Food and Drug Administration approval of the Neuronetics NeuroStar TMS device for the treatment of specific medication-resistant depression has raised a number of additional ethical concerns, including marketing, off-label use (...) and technician certification. This article provides an overview of the history of TMS and highlights the ethical questions that are likely arise as the therapeutic use of TMS continues to expand. (shrink)

This paper argues for a conditional claim concerning a famous argument—developed by Church in elucidation of some remarks by Frege to the effect that the bedeutung of a sentence is the sentence’s truth-value—the Frege–Gödel–Church argument, or FGC for short. The point we make is this :if, and just to the extent that, Arthur Smullyan’s argument against Quine's use of FGC is sound, then essentially the same rejoinder disposes also of Davidson's use of FGC against ‘correspondence’ theories of truth. We thus (...) dispute a contention by Professor Davidson that it is coherent to accept that Smullyan’s rejoinder takes away the force of Quine’s version of FGC, while still consistently using FGC to establish that if true sentences (or utterances) correspond to anything, they all correspond to the same thing. We show that the differences between the cases discussed by Smullyan and Davidson’s version of FGC on which Davidson relies for his contention are irrelevant to the point under dispute. (shrink)

Photography is clearly not a mirror of daily life: that images are constructions is especially obvious in 19th-century studio portrait photography. This book explores how indigenous Iranian photographers constructed their own realities in contrast to howforeign photographers constructed Iranians' realities. Through an in-depth comparative visual analysis of 19th-century Iranian portrait photography and Persian painting, the author arrives at the insight that aesthetic preferences correlate with socio-cultural habits and practices in writing, reading and looking. Se realizó una revisión bibliográfica con el objetivo de profundizar los conocimientos sobre el cólera y su historia. Se tratan aspectos relacionados con la etiología de la enfermedad, patogenia, cuadro clínico, tratamiento, epidemiología y prevención. El cólera es una enfermedad de origen multicausal donde intervienen factores biológicos, ambientales, sociales, políticos y culturales, la cual está resurgiendo como un problema sanitario de primera magnitud en muchos países. Para su erradicación es necesario desarrollar una fuerte promoción de salud en el seno de (...) la sociedad, garantizar atención rápida a enfermos y contactos e impedir la desorganización de la estructura social y económica en pro de la calidad de vida del ser humano. A bibliographical revision with the objective of deepening in the knowledge on cholera and its history was carried out. Some aspects related with its aetiology, pathology, clinical picture, treatment, epidemiology and prevention are considered. Cholera is an illness of multicausal origin where biological, environmental, social, political and cultural factors intervene. This disease is resurging as a sanitary problem of first magnitude in many countries. It is necessary to develop a strong promotion of health in the society to eradicate it, to guarantee a quick attention to sick and contacts and to impede the disorganization of the social and economic structure in favour of the quality of the human being life. In this short note I argue that, using the type of configurations put forward in a recent paper by Laraudogoitia in this same journal, new paradoxes of infinity of a completely different nature can be formulated.

This paper shows that, in Newtonian mechanics, unstable three-dimensional rigid bodies must exist. Laraudogoitia recently provided examples of one- and two-dimensional homogeneous unstable rigid bodies, conjecturing the instability would persist for three-dimensional bodies in four-dimensional space. My result proves that, if one admits non homogeneous balls or hollow spheres, then the conjecture is true without having to resort to tetra-dimensionality. Furthermore, I show that instability also holds for at least certain simple classes of elastic bodies. Altogether, the laws of classical (...) dynamics actually lead to the existence of unstable material bodies belonging to the three types of entities accepted therein: point particles, rigid bodies and continuous deformable bodies. A whole range of forms of indeterminism which, until now, has not been considered in the literature. I end with a new conjecture on the connection existing between all these forms of instability and the dimensionality of space. (shrink)

Es necesario enfocar escépticamente las pocas referencias a Pitágoras y los pitagóricos contenidas en los diálogos de Platón, pues resulta difícil tomar la medida efectiva de una influencia pitagórica sobre el ateniense. De hecho, las únicas referencias explícitas a Pitágoras (Rep. X 600a-b) y a los pitagóricos (Rep. VII 530c-531a) no nos dicen mucho y, respecto a los personajes tradicionalmente considerados pitagóricos, nuestra información es poco fiable, incierta y a veces contradictoria. Tal prudencia es particularmente útil en el caso de (...) Timeo y del personaje homónimo de este diálogo, cuyo pitagorismo, aunque ampliamente aceptado por los comentaristas, parece muy discutible. Así sólo la aplicación de un método histórico prudente y lúcido puede evitar esta deriva que identifica como pitagórico toda referencia a la transmigración del alma y las matemáticas en sentido amplio. Frente a la imagen de un Vico ajeno a las exigencias del rigor metódico, este trabajo se propone plantear: a) Que la preocupación por el problema del método es una constante en el pesamiento de Vico. b) Que su aportación debe considerarse especialmente relevante en lo que atañe a los actuales empeños rehabilitadores de la racionalidad práctica y, en particular, para las más recientes teorias de la argumentación jurídica. c) Que, no obstante lo anterior, la actitud metódico jurídica de Vico (...) no puede ser calificada de meramente "retórica", más bien, entraña un intento de proyectar principios de justificación racional a los tópicos argumentativos del Derecho; o a propiciar un esfuerzo integrador de los topoi retóricos de las controversias jurídicas con las exigencias justificatorias de la razón práctica. Para explicitar este enfoque se procederá a abordar, por aproximación sucesiva, tres cuestiones: 1ª) Los aspectos básicos del actual debate sobre la racionalidad juridica y la teoría de la argumentación en el Derecho. 2ª) La apelación a Vico como punto de partida del nuevo interés por la revalorización de la tópica jurídica. 3ª) El significado de la argumentación en el "interior" de la reflexión metódica viquiana y en sus proyecciones "externas" al presente. Sharia is a religious legal system that is based on the divine mandates revealed in the Quram and the Sunna as has been interpreted bu the main Islamic Schools of Law, both Sunni and Shiita. In orden to understand what is at stake, distinctions between the main Islamic traditions in this ground was one of the factors that have led to an imprecise use of terminology of the Quram which refers to the Islamic divorce, that is: the Talaq. Its confusion (...) has also been reflected in the case law of the Spanish Supreme Court which regards to the effects of Talaq under the Spanish Civil Law. Bilateral Accord concluded betwen the Spanish Goverment and the Islamic Religious Comunities of Spain has not regulated the requirements of the recognition of the islamic divorce in our legal system. Nevertheless, whether repudiation has been made under the Civil Law of a Muslim State, it could be recognized in Sapin under the rules of procedure of the International Private Law. The main purpose of such recognition is to guarantee the basic civil rights and liberties of the woman who has been repudiated. (shrink)
